By creating an account, purchasing a subscription, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes that organization.
If you do not agree, do not use the Services.
Lead QA provides scheduled and on-demand browser-based monitoring of public URLs that you configure. Typical checks include page health, call-to-action (CTA) availability, form dry-run validation (fill without submit), and limited custom browser assertions.
The Services are a monitoring and alerting tool for marketing and agency workflows. They are not a guarantee that every failure will be detected, that alerts will arrive before business impact occurs, or that monitored third-party sites will remain available or unchanged.
For every URL (or page) you add as a monitor, you represent and warrant that:
You remain solely responsible for the URLs you monitor. We may suspend or remove monitors, or suspend your account, if we reasonably believe a URL is unauthorized, abusive, or unlawful. This warranty survives termination for monitors you configured while the account was active.
You may only monitor URLs that you own or are expressly authorized to monitor (for example under a client care plan or written permission). Pointing Lead QA at a third-party site without authorization is prohibited and is grounds for immediate suspension.
You must not use the Services to:
We may investigate suspected violations and suspend or terminate access where we reasonably believe a violation has occurred.
You must provide accurate account information and keep credentials confidential. You are responsible for activity under your account, including actions by team members you invite. Notify us promptly of any unauthorized access.
Paid plans are billed in advance on a monthly or yearly basis via Stripe (or our designated payment processor). Fees are as shown at checkout and on our pricing page, unless we agree otherwise in writing.
The Services are provided "as is" and "as available" to the fullest extent permitted by law. We do not warrant that:
You are responsible for your own QA, client communication, and business continuity. We are not liable for leads, ad spend, or revenue lost because a failure was missed, delayed, or misclassified by the Services.
To the maximum extent permitted by applicable law (including Polish law), our aggregate liability arising out of or relating to the Services or these Terms — whether in contract, tort (including negligence), or otherwise — is limited to the fees you paid us for the Services in the three (3) months immediately preceding the event giving rise to the claim (or, if you are on a free plan, PLN 100).
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, goodwill, or business opportunity, even if advised of the possibility.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law (including liability for intentional misconduct or, where mandatory, for death or personal injury caused by negligence).
Because the Provider trades as a Polish sole proprietorship (JDG) with unlimited personal liability under Polish commercial rules, these caps are a material allocation of risk and a condition of providing the Services at the stated prices.
We and our licensors own the Services, including software, branding, and documentation. Subject to these Terms and your paid plan (if any), we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your internal business purposes.
You retain rights in your account content and monitor configuration. You grant us a licence to process that material solely to operate and improve the Services as described in the Privacy Policy.
Personal data is handled as described in our Privacy Policy. Where we process personal data on your behalf as a processor, a Data Processing Agreement may apply — see our DPA.
You may stop using the Services and cancel as described in §7. We may suspend or terminate access immediately for material breach (including authorization or acceptable-use violations), non-payment, abuse, legal risk, or to protect the Services or third parties.
On termination, your right to use the Services ends. Provisions that by nature should survive (including §§4–5, 8–11, 13–15) survive.
We may update these Terms from time to time. Material changes will be notified by email or in-product notice where appropriate. The "Last updated" / effective date above shows the current version. Continued use after the effective date constitutes acceptance, except where mandatory law requires otherwise.
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Subject to mandatory consumer or other protections that cannot be waived, the courts competent for Warszawa (Warsaw), Poland have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.
Questions about these Terms: contact@leadqa.app or our contact page.
